1. ELIGIBILITY: The Kentucky Lottery/University of Kentucky Game Day Giveaway Promotion (“Promotion”) is open only to legal residents of Kentucky who are 18 years of age or older at the time of entry. Employees of The Kentucky Lottery Corporation (“Sponsor”) and their “Promotional Participants” (i.e., University of Kentucky and each of their respective affiliates, subsidiaries, advertising and promotion agencies and suppliers involved in this promotion) and the immediate family members (mother, father, sister, brother, husband, wife, daughter, son, step-father, step-mother, step-daughter, step-son, step-brother, step-sister, half- brother, half-sister) and/or those living in the same household of each are not eligible. The Promotion is subject to all applicable federal, state and local laws and regulations and is void outside Kentucky and where prohibited by law.
2. AGREEMENT TO OFFICIAL RULES: By participating in this Promotion, entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsors and Administrators, which are final and binding in all matters related to the Promotion.
3. TO ENTER: Beginning 8:00a.m. Eastern Time (“ET”) on 8/20/18 through 11:59:59 p.m. ET on 9/16/18 log on to www.ukathletics.com/KYLOTTERY and follow the on-screen instructions to complete the online entry form. Limit one (1) entry per person/email address, per day. Multiple entrants are not permitted to share the same email address. Any attempt by a participant to exceed or manipulate the entry specifications and/or limitations, including by using multiple/different email addresses or any other methods, will void that entrant’s entries and that entrant may be disqualified.
4. RANDOM DRAWING: Potential Prize winner will be selected in a random drawing held on or about 9/17/18 from among all eligible entries received. Odds of winning depend on the number of eligible entries received by the entry deadline for each drawing.
5. WINNER NOTIFICATION: Potential winner will be notified by phone or email and must respond to the email/voicemail to confirm eligibility and agree to the Official Rules within two (2) days of receipt of email/voicemail (specified date and time will be listed in email notification or indicated in voicemail message). If the potential winner cannot be contacted, or he/she does not respond by designated deadline or if Administrator is unable to leave a message and/or the notification is returned as undeliverable, such potential winner will be automatically disqualified and an alternate potential winner may be selected, time permitting. Sponsors/Administrators assumes no responsibility for undeliverable emails resulting from any form of active or passive e-mail filtering by a user’s Internet service provider and/or e-mail client or insufficient space in user’s e-mail account to receive e-mail.
6. PRIZE & APPROXIMATE RETAIL VALUE (“ARV”): One (1) prize: Two (2) tickets to the 9/29/18 University of Kentucky Wildcats home football game in Lexington, KY. Prize also includes two (2) passes to the Big Blue Zone hospitality area, one (1) parking pass and a goody bag from Sponsor, including free coupon for $25 in Scratch-offs. ARV: $325. Seat location is at Sponsors’ sole discretion. Tickets are not redeemable or exchangeable for cash and are subject to all terms and conditions of use as established by issuer. Sponsors are not responsible if game is delayed, postponed or cancelled for any reason and winner will not be reimbursed for tickets, but tickets may be subject to standard rain check policies and procedures established by issuer. Winner and guests must be able to attend game on date specified or prize will be forfeited in its entirety. If Winner elects to attend game without the allotted number of guests, no additional compensation will be awarded in lieu thereof. If any guest of winner is deemed a minor in his/her state of residence, winner must be minor’s parent/legal guardian, or minor must be accompanied by his/her parent/legal guardian. Prize consists of only the items specifically listed as the prize. Sponsors reserve the right to substitute prize of equal or greater value. No substitution, cash redemption or transfer of prize by winner permitted. All federal, state and local taxes are the sole responsibility of winner.
7. PUBLICITY: Except where prohibited, participation in the Promotion and acceptance of a prize constitutes winner’s consent for Sponsors and Administrators to use winner’s name, likeness, prize information, city and state of residence for promotional purposes in any media without further consideration.
8. RELEASE AND LIMITATIONS OF LIABILITY/GENERAL CONDITIONS: Except where prohibited, by participating in the Promotion, entrants agree to release and hold harmless The Kentucky Lottery Corporation, University of Kentucky and their respective parents, subsidiaries, affiliates, promotional partners, prize partners, agents and agencies, and the officers, directors and employees of them (the “Released Parties”) (the “Released Parties”) from and against any claim or cause of action arising out of participation or attempt to participate in the Sweepstakes or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Sweepstakes or incorrect announcements of any kind; (b) printing errors, technical errors related to computers, servers, providers, printers or telephone or network lines; (c) errors in the administration of the Sweepstakes or the processing of entries; lost, late, damaged, delayed, incomplete, unintelligible or misdirected entries, entries not received by the entry deadline; (d) injury or damage to persons (including without limitation, death) or property which may be caused directly or indirectly, in whole or in part from entrant’s participation in the Sweepstakes or receipt, use or misuse of any prize. Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Sweepstakes and in no event shall the Released Parties be liable for attorney’s fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. If for any reason an entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another Sweepstakes entry, if it is possible. Any use of robotic, repetitive, automatic, programmed or like entry methods or agents (including, but not limited to, sweepstakes entry services) will void all entries by that entrant. In the event a dispute as to any online entry, the authorized account holder of the email address used to enter will be deemed to be the entrant. The “authorize account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for domain associated with the submitted address. Potential winner may be required to show proof of being the authorized account holder. Sponsors reserve the right to prohibit the participation of an individual if fraud or tampering is suspected, or if the individual fails to comply with any requirement of participation as stated herein or with any provision in these official rules. INTERNET CAUTION: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW. Sponsors reserve the right to cancel or modify the Sweepstakes if fraud, misconduct or technical failures destroy or undermine the integrity of the Sweepstakes or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper administration of the program as determined by the Sponsors/Administrators, in their sole discretion. In the event of termination, a notice will be posted online and the random drawing will be conducted from among all eligible entries received prior to the time of termination. No more than the stated number of prizes will be awarded. All materials submitted become the property of the Sponsors and will not be returned. By accepting prize, winner is solely responsible for the actions of his/her guests who accompany him/her to game and agree to indemnify and hold harmless the Released Parties for any and all claims, liability, damages, costs or expenses arising from the actions of his/her guests at game.
9. PRIVACY: All personal information submitted by you as part of this Promotion will be treated in accordance with the University of Kentucky Privacy Policy available at: http://www.ukathletics.com/page/kentucky-promotion-privacy-policy except as otherwise described in these Official Rules and sweepstakes materials. By participating in this Promotion, you acknowledge and agree that all information and material, including any personal information provided in your entry materials, affidavits, and releases, will be collected, used and disclosed by Sponsors and its authorized agents, representatives, and other third parties involved in the execution, administration, or hosting of this Sweepstakes, for the purposes of administering the Promotion and prize fulfillment and may be further publicized as described above.
